Northwest Territories PNP Categories: ​

There are three broad classifications under which the NTNP accepts immigration applications. Each category targets a different group of people and has its own eligibility rules, let us discuss each one of them in detail below:

  1. Northwest Territories Express Entry.
  2. Northwest Territories Express Entry.
  3. NTNP Business Driven Program.

1. Northwest Territories Express Entry

This stream of NTNP makes use of the Federal Government’s Express Entry Program to offer easy immigration to foreign nationals.

It helps overcome any labor market shortages by internationally skilled and qualified professionals.

Any candidate who fulfills all eligibility criteria and makes up for the lack of a local resource receives the permanent residency of Canada through this program.

This program has much lesser processing time than the traditional immigration program of Canada and thus considered much more efficient.

The candidates applying via this stream received priority for the processing of both their NTNP application and the permanent residency application.

There are further three sub-categories of this stream of Northwest Territories Canada PNP Program :

i) Federal Skilled Worker
ii) Federal Skilled Traders
iii) Canadian Experience Class

Apart from scoring high on the eligibility requirements of either of the above listed three classes, the candidate must also be able to showcase language proficiency in English or French.

The candidate should also be able to demonstrate possession of sufficient funds for his/her survival and survival of family members or other dependents in Canada.

Minimum Eligibility Criteria of Express Entry Program of NTNP.

Eligibility Criteria:

 

Following is the basic eligibility criteria for any candidate applying to the Express Entry Program of the Northwest Territories. The candidate must :

  •  Be eligible for either of the three federal economic immigration programs, namely: Federal Skilled Worker, Federal Skilled Trades, or Canadian Experience Class.
  • Meet the eligibility selection criteria for the Skilled Worker Stream under the NTNP Employer-Driven Program.
  • Be able to showcase his/her Express Entry Profile Number, and Job Seeker Validation Code issued to him/her by Immigration, Refugees, and Citizenship Canada (IRCC) Express Entry Pool; and
  • Have determination and personal interest in immigrating to the Northwest Territories.
  • Basic Employer Requirements under the Skilled Worker Stream
    In correspondence to the candidate’s eligibility, specific rules govern the eligibility of the employer as well.
  • An employer must : Own a registered industry association, a business entity, or a local, municipal, First Nation or Territorial Government, in the Northwest Territories of Canada.
  • Have been registered and his business must have been operational for at least six months.
  • Be in proper alignment with the Northwest Territories’ Workers’ Safety and Compensation Commission and the Northwest Territories’ Employment Standards office.
  • Extend the employment offer to the foreign national for a permanent, full-time position (minimum of 30 hours per week).
  • Provide a contract of employment that is consistent with the territories’ Employment Standards Act;
    o The employment contract must not be in any conflict with any existing collective bargaining agreements.
  • Provide valid proof of local and national advertising and share a summary of advertising;
    o The result summary must include a list of all application forms received in response to the advertised position and also a list of reasons for refusal of employment to the other candidates.
  • Offer a comparable industry rate of pay based on the businesses’ existing workforce rate-of-pay, rate-of-pay as advertised, and rate-of-pay in the LMIA; and
  • Strictly adhere to the LMIA agreement.
    Basic Applicant Requirements under the Skilled Worker Stream
    There is the following list of rules for the applying candidate to skilled worker stream of Northwest Territories Canada PNP Program.
  • The applicant must:
    • Own a legal status to work and have a valid work permit, if the candidate is currently residing in Canada.
  • Intend to settle permanently in the Northwest Territories of Canada.
  • Work in a NOC Skill Level 0, A, or B occupation only.
  • Possess the desired certification and accreditation for the occupation based on the employer’s precise requirements.
  • Have undergone formal education or specialized training required for the particular position.
  • Have relevant work experience required by the employer as mentioned in the job description or job advertisement by the employer; and
  • Fulfill other pre-requisites like NWT certification, licensing, or registration requirements of the job, if applicable;
  • Be able to communicate in English or French nicely;
  • Submit the following documentation in the original copy, or certified true copies (clear and a readable copy), translated into English or French:
    o Passport;
    o Birth certificate;
    o Marriage certificate; and
    o Birth certificate(s) and passport(s) for dependent(s).
  • Showcase sufficient funds for settlement to be able to establish themselves and any of their dependents in the Northwest Territories — the minimum requirement is $10,000 for the principal applicant, and an added $2,000 for each accompanying dependent;
    o As a proof of the settlement funds, the applicant must submit certified bank statements in their name or an official letter issued by a bank that has been translated to English or French and notarized.
  • Show genuine results from one of the following three approved language tests across Canada taken within two years of applying:
    o The International English Language Testing System (IELTS) General Training;
    o The Canadian English Language Proficiency Index Program (CELPIP-General); or
    o The Test d’Évaluation de Français (to test proficiency in French).

2. NTNP Employer-Driven Program

If any employers of the Northwest Territory of Canada has a particular requirement of the desired skillset, but there is not available any qualified Canadian or any permanent resident of Canada with relevant experience, the employer may appoint foreign candidates with international educational degrees and work experience for the said vacancy.

The employer-driven stream means that the employer has to sponsor the eligible candidates for permanent citizenship of Canada.

There are further two categories or streams under the employer-driven program of Northwest Territories Canada PNP Program:

i) Critical Impact Worker Stream:

This stream mainly addresses any critical labor shortage in the NWT that the local Canadian residents cannot meet and fulfill.

This stream has been designed specifically for the semi-skilled or unskilled personnel under the National Occupational Skill Level C and D.

For successful application to this stream, the candidate must possess a minimum of six-month working experience in the same or similar position and also must possess a valid temporary work permit of Canada.

ii) Skilled Worker Stream:

The Skilled Worker Stream of the employer-driven Northwest Territories Canada PNP Program is for skilled foreign nationals who are qualified enough to fulfill trained personnel shortages and vacant post with employers in NWT.

Applications of candidates that are skilled as per National Occupational Classification Skill Levels 0, A or B and have received employment offers from NWT employers are accepted in this stream.

Bare Minimum Requirements for Employers of Employer-Driven Stream:

Each employer of the employer-driven stream of the NTNP must:

  1. Itself be a registered business entity, industry association, or a local, municipal, First Nation / Territorial Government, in the Northwest Territories.
  2. Have been logged and running its operations for at least a one (1) year on a full-time basis just before applying.
  3. Have a clear report with the Northwest Territories’ Workers’ Safety and Compensation Commission and the Northwest Territories’ Employment Standards office.
  4. Make an employment offer to the foreign national for a full-time and permanent position (atleast 37.5 hours per week).
  5. Make an employment contract that is in synchronization with the territories’ Employment Standards Act;
    o The employment contract must not be in any conflict with an existing collective bargaining agreement.
  6. If applicable, share a copy of a positive Employment and Social Development Canada’s Labour Market Impact Assessment (LMIA)
    o An LMIA is not required for the Skilled Worker Stream, Express Entry System, or foreign nationals with open work permits of Canada.
  7. Provide proof of local and national advertising along with a summary of advertising results if nominating a foreign national without an LMIA;
    o The summary of results must also include a list of all application forms received in response to the employer’s advertised position and the list of detailed reasons for refusal of employment.
  8. Offer a comparable industry pay rate based on the businesses’ existing workforce’s rate-of-pay, rate-of-pay as mentioned in the advertisement, and rate-of-pay in the LMIA; and
  9. Necessarily adhere to the LMIA agreement.

Bare Minimum Requirements for Applicants of Employer-Driven Stream:

There are certain pre-requisites for foreign nationals to be eligible for immigration through the Employer-Driven Program of NTNP. Every candidate must :

  1. Possess a legal status to work and own a valid work permit, if currently living in Canada.
  2. Showcase genuine interest to settle permanently in the Northwest Territories of Canada.
  3. Possess the required certification for the employment opportunity based on the employer’s requirements.
  4. Meet the NWT certification, licensing, or registration requirements of the job, if any.
  5. Submit the below list of documentation in original, or certified true copies that must be a clear and legible, translated into either English or French:
    o Passport;
    o Birth certificate;
    o Marriage certificate; if marital status says married
    o Birth certificate(s) and passport(s) for dependent(s), if any.
  6. Showcase possession of sufficient settlement funds that will enable the candidate or any of the candidate’s dependents to settle in the Northwest Territories — the minimum monetary requirement is $10,000 for the principal applicant, and an additional $2,000 for each accompanying dependent or family member of the candidate;
    o All applicants must submit certified bank account statements in their name or an official letter issued by a bank, translated into either English or French and notarized, as proof of settlement funds of the candidate.
  7. Show passing results from one of the following three approved language tests taken within not more than two years for the date of application submission :
    o IELTS General Training – The International English Language Testing System

3. NTNP Business Driven Program :

This category of the Northwest Territories Canada PNP Program aims to attract candidates with a clear intention of setting up a new business or taking over an existing one in the Northwest Territories.

Through this stream, NWT’s provincial immigration program is looking for applicants who have experience in running their business entities and also possess sufficient funds to start a new one in the Northwest Territories of Canada to enhance the growth and development of the economy.

If the candidate wishes to purchase an existing business, he/she must possess sufficient investment. Candidates are also shortlisted on their capability of creating jobs for the Canadian residents and also for the foreign nationals in the northwest territory of Canada.

The application process of the business-driven program begins with the candidate sharing his working business concept and demonstrates his/her keen desire to move to NWT.

IRCC then reviews Their applications and business proposals. If the candidate’s business plan is approved and executed, the candidate if offered the nomination certificate. After this, the candidate can apply for permanent residency at IRCC.

There are two broad categories under the business-driven stream of the Northwest Territories Canada PNP Program :

i) The entrepreneur stream:

This stream facilitates the immigration of candidates who plan to set up their own business in NWT and also reside in NWT itself.

Applicants from all business sectors are eligible here. However, if you plan to set up a shop of a new product or service which is not currently present in the territory, you are offered priority of assessment over other applicants.

You may also be preferred if your business plan is probably to offer significantly more benefits to the territory’s economy in comparison to other business proposals received.

ii) Self-employed stream:

This stream is not accepting any new applications at the moment. It may re-open for new applications sometime in 2019.

This stream is valid for individuals who can aid in business growth by opening new business outlets and centers of professional practices.

This stream is strictly for self-employed candidates only and does not consider professionals employed by businesses as eligible.

Nomination Process of Business Driven Northwest Territory Provincial Nominee Program

  1. Self-assessment of eligibility and initial investigations
  2. Further studies and person-to-person interviews
  3. Commencing the application process and pre-screening
  4. Formal application submission
  5. Application review
  6. Application approval and business performance agreement
  7. Establishing the business entity
  8. Nomination of the candidate.

Basic Requirements for the Entrepreneur Stream:

For an applying candidate to be eligible as an entrepreneur under the Business Driven Program of Northwest Territories Canada PNP Program, the applicant must:

  1.  Make an Investment :
    o Atleast CAD 3,00,000 for starting or purchasing a business within the corporate boundaries of Yellowknife, Northwest Territories; or
    o Atleast CAD 150,000 for starting or buying a company outside of the corporate limits of Yellowknife, Northwest Territories.
  2. Must have a minimum personal net worth of:
    o Minimum CAD 500,000 if commencing or purchasing a business within the corporate boundaries of Yellowknife, Northwest Territories; or
    o Minimum CAD 250,000 if initiating or buying a company outside the corporate limits of Yellowknife, Northwest Territories.
  3. Showcase that they are the owner of atleast one-third (33.3 percent) of the business;
    o If the applying candidate makes a personal equity investment of CAD 1,000,000 or more, he or she may own less than one-third (33.3 percent).
  4. Offer a good faith deposit of CAD 75,000 to be held in a trust with NWT and released upon satisfactory execution of the terms of the Business Performance Agreement by the candidate.
  5. Showcase sufficient knowledge and understanding of the Northwest Territories and its economy.
  6. Showcase appropriate communication skills to establish and conduct business in the Northwest Territories of Canada and to integrate into the local community; and
  7. Possess the necessary work experience and education to implement the business plan successfully.

Basic Requirements of Eligibility for the Self Employed Stream:

For candidates to apply for immigration to the Northwest Territories of Canada under the Self Employed Stream of the Business Driven Program, there is a pre-defined set of rules. Each applicant must:

  1. Be a dignified member of the profession relevant to which there is an identified professional skill shortage in the Northwest Territories.
  2. Fulfill any certification or accreditation requirements for the business or occupation applied for.
  3. Be capable of meeting all Northwest Territories regulatory authority requirements if in a regulated job;
    o If no regulatory authority exists within NWT, then the Canadian licensing body will be consulted for the same.
  4. Showcase sufficient communication skills to conduct business in the Northwest Territories and to integrate the same into the local community.
  5. Possess and showcase reasonable knowledge and understanding of the Northwest Territories and its economy.
  6. Also, showcase access to sufficient monetary resources to start and commence a professional practice and to support themselves or any family members or dependents for a period of six months; and
  7. Submit a detailed business proposal and plan for the business practice.

The Business Plan Guidelines of the Business Driven Stream:

The business plan that the candidate plans to propose to IRCC for its immigration process via the Northwest Territories Canada PNP Program must be a detailed one which has been well thought of for successful establishment and prepared with professional assistance for business development in NWT.

  • The plan should mention the process that the applicant plans to execute for the success of his business venture and that its business operations can begin upon the candidate’s arrival.
  • This plan should also share details of the research conducted by the candidate relevant to the economic, market and cultural factors of the province and also showcase the candidate’s skills and experience.
  • The applicant may take help from any third party for the development of his business plan.
  • However, NWT expects the candidate to have precise knowledge and understanding of the strategy and its execution.
  • The application may be denied if the authorities feel that the candidate lacks the experience of the plan.

Required Content of the Business Plan:

The business plan submitted for business-driven stream must include the following:

  1. Proposed name of the company and the description of the business concept;
  2.  Business ownership details – partnership, proprietorship, corporation, acquisition, franchise, others;

Proposed business industry/sector;

Applicants must mention:

  • The industry-specific sector code(s) that are the best possible match for their proposed investment (as per the North American Industry Classification); and
  • The occupation code(s) that are the best possible match for their experience levels and skillset (as per the National Occupation Classification) system.

Suggested location for the business;

  • Plans for residing in the Northwest Territories.
  • Management contribution the applicant intends to make for the proposed transaction.
  • Proposed investment amount for the business and detailed explanation of how it will be spent.
  • Fore-casted start-up expenses and funds.
  • Pro‐forma financial data and if applicable, a financing plan.
  • Number of jobs that are probable to be created for NWT residents.
  • Market research performed and all other supporting analysis documents.
  • A list of planned past or future visits to the Northwest Territories, whenever applicable.
  • Any preparation and training for entrepreneurship in the Northwest Territories of Canada (to include course titles and institution names).
  • All details like name, mailing addresses, organizations, phone numbers, emails of contracted professional business service providers whom the prospective candidate has contacted to establish an active working relationship or made a payment on the contractual agreement.
  • A summary of the people contracted or consulted for the preparation or compilation of the business plan, including the name, organization name, mailing address, e‐mail address and phone number of each.

When Not to Apply for Business Driven Stream of Northwest Territories Canada PNP Program?

There are a few rules that can declare the applicant to be ineligible or immigration under the business-driven stream.

The candidate is considered inappropriate if, he/she :

  • Does not meet any of the eligibility mentioned above criteria.
  • Alternatively, any dependent or family member of the candidates has a severe medical condition.
  • If any family member or dependant above the age of 18 whether or not accompanying the candidate has a criminal record.
  • Has yet-to-be resolved custodial or child support disputes affecting any member of their family.
  • Is a refugee claimant in Canada.
  • Is involved in a federal appeal or removal process.
  • Has active applications with other provincial nominee programs of Canada.
  • Has intentionally misrepresented data during the application process.
  • Has intentionally committed fraud during the application process; or
  • Has proposed investment into a business entity, where the business is being established and operated primarily to derive passive investment income.
